Speed has nothing to due with an expired tank. The tank leaking is the concern. NYC buses are set for 40 MPH top speed for the most part.

Is there a point as to way the MTA governs their buses. Are NICE's buses governed too?

Yes there is a reason, max speed limit in NYC is 50 MPH. On parkways buses are limited to 30 MPH. Locals don't need to be able to do 50. Express buses are able to reach posted speed limits. And if need be they can always be adjusted.
